Acceptance
By using Fundnode (the "Site"), you agree to these Terms. If you don't agree, please don't use the Site.
What we are
Fundnode is a small-business funding referral platform operated by Fundnode LLC. We are not a lender, bank, or broker of record. We do not extend capital, hold deposits, or service loans. We match merchants with third-party funding partners. Any financing agreement you sign is with the funder, not with us. See /trust for full posture.
Eligibility
You may use the Site if you are:
- At least 18 years old
- Authorized to act on behalf of a US-based business entity
- Located in a state where we currently operate (Florida, Texas, Georgia) — other states join our waitlist
- Not on any US government sanctions list
- Not previously banned from the Site
Your obligations
You agree to:
- Provide truthful, accurate, current, and complete information
- Update your information when it changes
- Use the Site only for legitimate business funding inquiries
- Not impersonate another business or person
- Not misuse, scrape, reverse-engineer, or interfere with the Site
- Comply with all applicable laws
Compensation disclosure (FTC)
When you fund through a partner we refer you to, that partner may pay us a referral fee. This compensation comes from the partner's margin, not from your factor rate or APR. We disclose this on pages displaying partner offers. See /trust for the full disclosure.
Funder relationships
Funding partners are independent companies that underwrite, approve, fund, and service financing on their own terms. We do not control the partner's decision, underwriting criteria, or contract terms. Any disputes about the financing are between you and the funder.
Intellectual property
The Site, including all content, design, branding, code, and trademarks, is owned by Fundnode LLC or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission, except as expressly allowed (e.g., embedding our calculator under the terms at /calculator/embed/install).
Prohibited uses
You may not:
- Submit false or misleading information
- Submit applications on behalf of someone else without authorization
- Use the Site to harass, defraud, or harm any person or entity
- Attempt unauthorized access to our systems
- Use automated tools (bots, scrapers) to harvest information from the Site
- Resell or redistribute matches or our content without permission
Disclaimers
The Site is provided "as is." We make no guarantee that any funding application will be approved, that any factor rate or APR shown indicatively will be the final rate offered, or that any funder will respond within a specific timeframe. Pre-qualification results are indicative only.
Editorial content (articles, guides, calculators) is for general information and not financial, legal, tax, or accounting advice. Talk to a licensed professional for advice specific to your business.
Limitation of liability
To the maximum extent permitted by law, Fundnode LLC is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or business opportunity, arising out of or related to your use of the Site or any funding you obtain through a partner. Our total aggregate liability is limited to $100 or the amount of compensation we've received from referrals you submitted in the prior 12 months, whichever is greater.
Indemnification
You agree to indemnify and hold Fundnode LLC harmless from any claim arising from your misuse of the Site, your breach of these Terms, or your violation of any law or third-party right.
Dispute resolution
Any dispute arising from these Terms or your use of the Site will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration takes place in Delaware. Either party may seek injunctive relief in court for intellectual property disputes.
Class action waiver: You agree to resolve disputes only on an individual basis, not as part of a class.
Governing law
Delaware law governs these Terms, without regard to conflict-of-laws principles.
Changes
We may update these Terms. Material changes will be flagged on this page and (if we have your email) sent to you. Your continued use after changes means you accept them.
